DISSENTING OPINION OF JUDGE TÃœRMEN

I disagree with the majority concerning the violations of Article 8 of the Convention and Article 1 of Protocol No. 1 for the reasons contained in the separate dissenting opinions of Judge Bernhardt joined by Judge Lopes Rocha and of Judges Baka, Jambrek , Pettiti and Gölcüklü in the Loizidou v. Turkey (merits) judgment of 18 December 1996.
