DISSENTING OPINION OF MR. J.-C. SOYER

I have voted against the finding of the Commission that no

separate issue arises in respect of the complaint under Article 13 of

the Convention.

In my view, the conclusion should be that there has been no

violation of Article 13 of the Convention.
