SUBJECT MATTER OF THE CASE

The application concerns the travel ban imposed by the domestic courts for an unpaid debt on the applicant who was prevented from leaving Azerbaijan, as well as the fairness of those proceedings.

QUESTIONS TO THE PARTIES

1. Was any restriction placed on the applicant’s freedom to leave the territory of the respondent State, as guaranteed by Article 2 § 2 of Protocol No. 4 to the Convention? If so, was that restriction in accordance with the law and necessary in terms of Article 2 § 3 of Protocol No. 4 to the Convention?

2. Did the applicant have a fair hearing in the determination of her civil rights and obligations, in accordance with Article 6 § 1 of the Convention? In particular, did the domestic courts provide reasons for their decisions?
