SUBJECT MATTER OF THE CASE
The application concerns a complaint about the ineffective investigation into beatings inflicted on the applicant, a father, in front of his two minor children, on 17 February 2012. The assault took place in a yard near a multi ‑ storied building where he lived, by his neighbours, Mr and Mrs R., on the ground of a dispute over a dog’s behaviour, which Mrs R. had been walking. The applicant sustained minor bodily injuries, particularly, concussion, contused wound, abrasions and a cut wound on the head, and a bruise on the left thigh. The investigation into the events, commenced in 2013, is still pending. The applicant raised a complaint under Article 3 of the Convention.
QUESTION TO THE PARTIES
Having regard to the procedural protection from inhuman or degrading treatment (see Muta v. Ukraine , no. 37246/06, § 59, 31 July 2012; Skorokhodov v. Ukraine , no. 56697/09, § 32, 14 November 2013, and Aleksandr Nikonenko v. Ukraine , no. 54755/08, § 43, 14 November 2013), was the investigation in the present case by the domestic authorities in breach of Article 3 of the Convention?
