SUBJECT MATTER OF THE CASE
The application concerns a complaint about a breach of Article 3 of Protocol No. 1 to the Convention as a result of the impossibility for the applicants to vote in two legislative elections for Bulgarian Parliament, held respectively on 4 April 2021 and 11 July 2021, because they were convicted prisoners effectively serving their sentences at the time the elections were held.
QUESTION TO THE PARTIES
Has there been a breach of the applicants’ right under Article 3 of Protocol No. 1 to the Convention to vote in free elections which ensure the free expression of the opinion of the people in the choice of legislature (see, among others, Kulinski and Sabev v. Bulgaria , no. 63849/09 , §§ 10–22, 21 July 2016 and, also, Anchugov and Gladkov v. Russia , nos. 11157/04 and 15162/05, 4 July 2013 and Resolution CM/ResDH(2019)240 in respect of related developments), as regards the elections for Bulgarian Parliament held respectively on 4 April 2021 and 11 July 2021?
