SUBJECT MATTER OF THE CASE

The first applicant is a mother of a two-year-old child (the second applicant). The application concerns the applicants’ involuntary placement in a clinical infectious diseases hospital on suspicion of Coronavirus infection. The placement was ordered on 8 April 2020 by the Leninskiy District Court of Kemerovo at the request of the chief sanitary doctor of Kemerovo Region. The applicants stayed at the hospital from 9 until 14 April 2020.

QUESTIONS TO THE PARTIES

Has the applicants’ involuntary hospitalisation in the period between 9 and 14 April 2020 been lawful within the meaning of Article 5 § 1 (e) of the Convention? In particular, what was the legal basis for the applicants’ involuntary hospitalisation? The parties are invited to submit to the Court references to the relevant provisions of the domestic law and judicial practice, where available.
