SUBJECT MATTER OF THE CASE
The application concerns the living conditions of the applicants, a mother with a newborn baby at the time of lodging their application with the Court. They lived in a tent in the forest outside the Samos “hotspot” and they were subsequently placed in a container inside the “hotspot”.
The applicants rely upon Articles 3, 8 and 13 of the Convention.
QUESTIONS TO THE PARTIES
1. Having regard to the fact that the applicant mother was at an advanced stage of pregnancy, and that according to her allegations she did not have access to the necessary healthcare, were her living conditions compatible with Article 3 and/or Article 8 of the Convention? Were the applicants’ living conditions, prior and after their placement in a container, compatible with Article 3 and/or Article 8 of the Convention?
2. Did the applicants have at their disposal an effective remedy to complain about their living conditions, as required under Article 13 of the Convention?
