SUBJECT MATTER OF THE CASE

The application concerns the living conditions of the applicants, a pregnant woman at the time of lodging her application with the Court and her minor daughter. They lived in a tent in the forest outside the Samos “hotspot”.

The applicants invoke Articles 3, 8 and 13 of the Convention.

QUESTIONS TO THE PARTIES

1. Having regard to the fact that the first applicant was at an advanced stage of pregnancy, and that according to her allegations she did not have access to the required/appropriate healthcare, were her living conditions compatible with Article 3 and/or Article 8 of the Convention? Were the living conditions in respect of the 3-year-old minor applicant compatible with Article 3 and/or Article 8 of the Convention?

2. Did the applicants have at their disposal an effective remedy to complain about their living conditions, as required under Article 13 of the Convention?
