SUBJECT MATTER OF THE CASES

The present four applications concern the domestic courts’ decisions sentencing the applicants to various periods of administrative detention under Article 528 of the Code of Administrative Offences for non-enforcement of a court judgment.

QUESTIONS TO THE PARTIES

1. Did the applicants have a fair hearing in the determination of the criminal charges against them, in accordance with Article 6 § 1 of the Convention? In particular, did the domestic courts establish the existence of all the elements of the offence of which the applicants were convicted and provide reasons for their decisions (see Karimov and Others v. Azerbaijan , nos. 24219/16 and 2 others, 22 July 2021)?

2. Were the applicants deprived of their liberty merely on the ground of their inability to fulfil a contractual obligation, contrary to Article 1 of Protocol No. 4?
