SUBJECT MATTER OF THE CASE
The application concerns the ill-treatment of the applicant by private individuals and the ineffective investigation into that ill-treatment. The applicant was subject to a violent assault in 2011 resulting in multiple bruises, abrasions and broken ribs. After the courts have repeatedly ordered the reopening of the criminal investigation, in 2018 the case was discontinued in respect of two main suspects due to the expiry of procedural time-limits and suspended with the identification of other suspects pending. The applicant complains about a violation on his rights under the procedural limb of Article 3 of the Convention.
QUESTION TO THE PARTIES
Having regard to the procedural protection from inhuman or degrading treatment (see paragraph 131 of Labita v. Italy [GC], no. 26772/95, ECHR 2000-IV), was the investigation in the present case by the domestic authorities in breach of Article 3 of the Convention ( Ceachir v. the Republic of Moldova, no. 50115/06, 10 December 2013)?
