SUBJECT MATTER OF THE CASE

The applicant complains under Article 3 of the Convention that he was body searched by the police in a humiliating manner on 31 May 2021, and that by a final decision of 1 October 2021 the Regional Prosecutor dismissed his complaint, finding no basis for initiating a criminal investigation.

QUESTIONS TO THE PARTIES

1. Was the applicant subjected to a body search on 31 May 2021 in breach of Article 3 of the Convention (see, for example, Frérot v. France , no. 70204/01, § 38, 12 June 2007)?

2. Did the Regional Prosecutor’s decision of 1 October 2021 not to initiate criminal proceedings in this respect comply with the procedural aspect of Article 3 of the Convention (see, for example, Jeronovičs v. Latvia [GC], no. 44898/10, § 103, 5 July 2016)?
