SUBJECT MATTER OF THE CASE

The application concerns the alleged lack of impartiality of the Zadar Municipal Court based on the fact that the unmarried partner of the applicant’s opponent in the civil proceedings was a law clerk of that court and also testified in those proceedings.

QUESTION TO THE PARTIES

Was the Zadar Municipal Court which dealt with the applicant’s case at the first instance impartial, as required by Article 6 § 1 of the Convention (see Boyan Gospodinov v. Bulgaria , no. 28417/07, 5 April 2018; Igor Kabanov v. Russia , no. 8921/05, 3 February 2011, and Dorozhko and Pozharskiy v. Estonia , nos. 14659/04 and 16855/04, 24 April 2008)?
