Length of pre-trial detention
Length of detention on remand: non-exhaustion
The case concerns the length of detention on remand. The Court noted that while the applicant had lodged an appeal to the Court of Cassation against a decision of the Indictments Chamber, the appeal h ad been rejected as inadmissible because of its novelty. The Court concluded that the applicant had not exhausted domestic remedies (see the Civet v. France judgment of 28 September 1999). It therefore upheld the Government’s preliminary objection.
