Lawful arrest or detention

Placement in police custody following refusal to disclose identity: admissible

On 11 August 1995 the applicant was accused by a conductor of travelling on a public bus without a valid ticket. A dispute started and the police were called. The a pplicant refused to give her name and address and was arrested at 9.30 p.m., in accordance with the Administration of Justice Act, and taken to a police station. She was put in a waiting room at 9.45 p.m. and moved to a detention cell at 11 p.m. The next d ay, at 10.45 a.m., she disclosed her identity and was released at 11 a.m. She complains about that her detention was unlawful.
