Right not to be tried or punished twice

Applicant prosecuted twice for the same offence: case referred to the Grand Chamber

The applicant complained that, after he had already served three days' detention for committing disorderly acts, he had been re-detained and tried again for the same offence. In its Chamber judgment the Court found unanimously that the applicant had been tried and prosecuted twice concerning an offence for which he had already been convicted and served a term of detention. Accor dingly, there had been a violation of Article 4 of Protocol No. 7.

On 112 November 2007 the case was referred to the Grand Chamber at the Government’s request.
