STATEMENT OF FACTS

THE FACTS

The applicant is a Kyrgyz national who suffers from a sever e medical condition and is in need of reg u lar, life-sustaning treatment. He claims that he will not receive this treatment within adequate time in his country of origin. After arriving in Sweden , he applied for asylum.

COMPLAINT

The applicant complains under Article 3 of the Convention that, if deported from Sweden to Kyrgyzstan , he would not receive adequate medical treatment for his illness in Kyrgyzstan and would thus die within a few weeks.

QUESTION TO THE PARTIES

In light of the applicant ’ s health condition, would he face a risk of being subjected to treatment in breach of Article 3 of the Convention if the depor tation order were implemented?
