Application no. 4140/04 Aurelia ROMAN against Romania lodged on 15 December 2003

QUESTIONS TO THE PARTIES

1. Has there been a violation of Article 3 of the Convention on account of:

( a) the material conditions of the applicant ’ s detention in the Bucharest Police Department ’ s Arrest from 21 April to 4 July 2003 and the fact that she was placed in a room with other smoking detainees for the same period of time;

( b) the lack of access to adequate medical care in the Bucharest Police Department ’ s Arrest from 21 April to 27 June 2003?

The Government are invited to provide information and supporting documents on the material conditions of the applicant ’ s detention throughout the entire period of detention mentioned above, more specifically with regard to the alleged overcrowding; small, damp, vermin infested rooms; lack of natural light, sufficient air and breathing difficulties because of cigarette smoke, lack of warm water and exercise as well as poor food, lack of hygiene and bathroom facilities.

The Government are also invited to submit copies of the applicant ’ s medical records in respect of her allegations concerning lack of access to adequate medical care for the period mentioned above.

2. Was the length of the two sets of civil proceedings brought against the applicant by third parties in the present case in breach of the “reasonable time” requirement of Article 6 § 1 of the Convention?
