STATEMENT OF FACTS

THE FACTS

The applicant, Mr B.Z.S., is an Iraqi national who was born in 1971 and is currently residing in the Netherlands . He is represented before the Court by Ms E.P.A. Zwart , a lawyer practising in Beverwijk .

On 1 March 2009 the applicant unsuccessfully applied for asylum in the Netherlands . The final decision on this application was taken by the Administrative Jurisdiction Division ( Afdeling Bestuursrechtspraak van de Raad van State ) on 17 February 2012.

COMPLAINTS

The applicant complains that his expulsion to Iraq will subject him to treatment in breach of Article 3 of the Convention. He further submits that, in violation of Article 13 of the Convention, the Netherlands authorities did not conduct their examination of his asylum application with rigorous scrutiny.

QUESTION TO THE PARTIES

In the light of the applicant ’ s claims and the documents which have been submitted , would he face a real risk of being subjected to treatment in breach of Article 3 of the Convention if he were expelled to Iraq ?
