STATEMENT OF FACTS

FACTS

The applicant claims to be from Central Darf ur and to belong in the paternal line to the ethnic group of the Fur and in the maternal line to the ethnic group of the Bergo . In Switzerland he has been politically active as member of the Sudanese Liberation Movement/Unit and the Darfur Peace and Development Centre (DFEZ) .

COMPLAINTS

Relying on Article 2 and 3 of the Convention the applicant fears that his deportation to Sudan would expose him to the risk of being killed or ill-treated and tortured.

Relying on Article 13 of the Convention, the applicant claims that he does not have an eff ective remedy at national level to enforce his rights under Article 2 and 3 of the Convention.

QUESTION TO THE PARTIES

In the light of the applicant ’ s claims and the documents which have been submitted, would he face a risk of being subjected to treatment in breach of Article 3 of the Convention if the deportation order were enforced ?
