STATEMENT OF FACTS

The applicant is a Sri Lankan national who has applied for asylum in Finland. He is represented before the Court by Ms Anne Siitonen from Lappeenranta.

COMPLAINT S

The applicant complain under Article 3 of the Convention that he would be subjected to inhuman treatment if expelled to Sri Lanka . He stated that he fears persecution by the Sri Lankan authorities due to his assumed affiliation with the LTTE.

The applicant complains under Article 13 of the Convention that he should have an effective remedy, that is, he should be allowed to stay in Finland until a final decision has been given in his case. He also complains that the domestic courts did not consider properly the country information and the risk factors in his case.

QUESTION

In the light of the applicant ’ s claims and the documents which have been submitted, would he face a risk of being subjected to treatment in breach of Article 3 of the Convention if he is expelled to Sri Lanka ?
