Application no . 40512/13 Sergey Vasilyevich ANTONOV against Ukraine lodged on 21 June 2013

STATEMENT OF FACTS

The applicant is in pre-trial detention in Kyiv SIZO (pre-trial detention centre) since 27 September 2012. He suffers from AIDS, tuberculosis, hepatitis C, and candidiasis. On 8 November 2012 he was examined by the penitentiary doctor who confirmed the said diagnoses (a copy of the doctor ’ s statement attached to the request).

On 9 January 2013 the applicant was again examined by the penitentiary doctor who stated that the applicant ’ s state of health had worsened.

Since 14 February 2013 the applicant is in the medical facility of the SIZO, and his state of health is constantly aggravating. In June 2013 it became critical (the representative states that the applicant cannot get up, constantly suffers from headaches, stomach aches, liver aches, loss of weight, ulcers everywhere on his body, diarrhoea, inflammation of lymph nodes, insomnia etc ).

On 14 June 2013 SIZO officials informed the police authorities that the applicant ’ s state of health is aggravating and might lead to his death (a copy of the letter attached to the request). They confirmed that, apart from the said diagnoses, the applicant suffers from inflammation of lymph nodes, dermatitis, intestinal dysbacteriosis etc. They also stated that the applicant needed a long-term medical treatment in the conditions of a specialized medical facility. Consequently, they asked to quicken the investigation, and to consider the possibility to release the applicant. The document was signed by the head of the SIZO and the head of the SIZO ’ s medical department.

On 18 June 2013 the applicant ’ s representative lodged a request for release, too, but did not receive any answer yet.

COMPLAINTS

The applicant complain s under Article 3 of the Convention of lack of appropriate medical assistance in detention .

QUESTION TO THE PARTIES:

1. Wh a t kind of medical treatment and assistance is provided to the applicant in the SIZO , and is such treatment sufficient with regards to the requirements of Article 3 of the Convention?
