QUESTIONS

1. In the light of the applicant ’ s claims, the documents which have been submitted and UNHCR ’ s Eligibility Guidelines for Assessing the International Protection Needs of Afghan Asylum-Seekers of December 2010, would he face a real risk of being subjected to treatment in breach of Article 3 of the Convention if he were expelled to Afghanistan?

2. Has the refusal to admit the applicant to the Netherlands breached his right to respect for his family life, within the meaning of Article 8 of the Convention?

3. Did the applicant have at his disposal an effective domestic remedy for his complaint s under Article s 3 and 8, as required by Article 13 of the Convention?
