Application no. 68562/12 Gheorghe RĂCHITĂ against Romania lodged on 11 October 2012

STATEMENT OF FACTS

The applicant , Mr Gheorghe Răchită , is a Romanian national , who was born in 1972 and lives in Botoșani .

The facts of the case , as submitted by the applicant , may be summarised as follows.

The applicant has been convicted to prison sentence at an unspecified date. He has been serving his sentence in the following penitentiaries: Botoșani , Timișoara , Tulcea and Iași , with no indication of the specific dates. He was also under medical care in the Poarta Albă Prison Hospital on 19 and 20 November 2012.

The applicant states that the conditions of detention are inhuman. More precisely , the applicant complains that in the Botoșani , Timișoara , Tulcea and Iași Penitentiaries: ( i ) the cells are overcrowded and dirty , infested with mice and different types of bugs; (ii) the food is of poor hygienic quality , infested with w o rms. Moreover, in the Botoșani Penitentiary: ( i ) the quantity of food does not respect the legal norms; (ii) the detainees are not provided with hot water , cleaning supplies , bed linen and clothes; (iii) the detainees are not taken out for walks or for social or work activities and they do not receive medical treatment.

The applicant also complains that during his hospitalization in the Poarta Albă Prison Hospital: ( i ) the rooms were dirty and infested with different types of bugs; (ii) he did not receive food or items for personal hygiene.

COMPLAINT

By invoking in substance Article 3 of the Convention , t he applicant complains of the inhuman and degrading conditions of detention, as described above , in the Boto șani , Timișoara, Tulcea and Iași Penitentiaries and Poarta Alb ă Prison Hospita l .

QUESTIONS TO THE PARTIES

1. Has the applicant been subjected , in breach of Article 3 of the Convention , to inhuman or degrading treatment in the Botoșani , Timi șoara , Tulcea and Iași Penitentiaries and in the Poarta Alb ă Prison Hospital?

2. The Government are invited to provide informati on on the applicant ’ s conditions of detention in the Botoșani , Timișoara , Tulcea and Iași Penitentiaries and in the Poarta Alb ă Prison Hospital , in particular in connection with the material conditions of the cells and hospital rooms where the applicant has been detained , namely the size of the cells and hospital rooms , the number of beds and the number of persons being detained in the same cell with the applicant, the sanitary ins tallation available in the cell and hospital room and the measures taken to ensure the hygiene in the cell and hospital room especially against different types of bugs and mice. The Government are also invited to provide information regarding the quality and quantity of food made available to the applicant , the measures taken to ensure the personal hygiene of the applicant , the availability of social or work activities and the frequency with which the applicant is being taken out for walks outside his cell.
