Application no. 75758/12 Virgil Constantin PURCĂRESCU against Romania lodged on 20 November 2012

STATEMENT OF FACTS

The applicant, Mr Virgil Constantin Purcărescu , is a Romanian national, who was born in 1980. He is currently serving a prison sentence in the Bistriţa Penitentiary.

The facts of the case, as submitted by the applicant, may be summarised as follows.

The applicant, sentenced on 27 June 2012 by the High Court of Cassation and Justice, to three years and four months imprisonment, is currently serving his conviction in the Bistriţa Penitentiary, after being initially detained in the Aiud Penitentiary for thirty days and after that, until 4 September 2012, in the Bȃrcea Mare Penitentiary.

He states that the conditions of detention in all the penitentiaries mentioned above are inhuman and degrading due to overcrowding. He describes that between forty-five to forty-eight inmates have to share a cell having a length of 12 meters and a width of 6 meters.

He also refers to the poor hygiene, namely that there are only two showers and two sinks available, the water being strictly limited and that the cell is infested with bedbugs. He claims that due to dirtiness, he had developed various allergies, that led to several wounds and scars.

COMPLAINT

The applicant complains under Article 3 of the Convention about the inhuman and degrading conditions of detention, as described above, in the Aiud , Bȃrcea Mare and Bistriţa Penitentiaries .

QUESTIONS TO THE PARTIES

1. Has the applicant been subject, in breach of Article 3 of the Convention, to inhuman or degrading treatment in the Aiud , Bȃrcea Mare and Bistriţa Penitentiaries?

2. The Government are invited to provide information on the applicant ’ s detention conditions in the Aiud , Bȃrcea Mare and Bistriţa Penitentiaries, in particular in connection with the cells where the applicant has been detained, stating particularly the number of beds and the number of persons being detained in the same cell with the applicant, but also the other material conditions of detention , such as the size of the cell, the number and size of the windows, the sanitary installation s available and the measures taken to ensure hygiene in the cells .
