STATEMENT OF FACTS
The applicant, Mr Alexandru Marius Radu , is a Romanian national, who was born in 1974 . He is currently serving his prison sentence in Giurgiu P rison.
The facts of the case, as submitted by the applicant, may be summarised as follows.
1. The conditions of detention in Giurgiu Prison
T he applicant was held in a number of different detention centers. However, he is complaining only about the conditions of his detention in Giurgiu Priso n where he was transferred on 8 December 2012.
Without indicating the surface of the cell the applicant complains of overcrowding. He claims that he shares the cell with co-detainees suffering from hepatitis C and D.
He also claims that the cell is infested with bugs and that the prison has no designated eating area and the detainees a re forced to eat in their cells.
Windows are covered with steel plates and t here is no fresh air in the cells and enough natural light .
According to the applicant there is no hot water and the potable water is cut off between 11 p.m. and 5 a.m. each night.
2. The conditions of transport
The applicant claims that the conditions of his transportation to and from the court hearings are inhuman and degrading . The vans are severely overcrowded and let no natural light or air in .
COMPLAINTS
1. The applicant complains under Article 3 of the Convention about the material conditions of detention in Giurgiu Prison , in particular overcrowding, poor conditions of hygiene, lack o f sufficient and adequate food.
2. Under the same article h e complains about the conditions of his transportation to and from the court hearings are inhuman and degrading in overcrowded vans.
QUESTIONs TO THE PARTIES
1 . Did the conditions of the applicant ’ s detention in Giurgiu Prison breach the requirements of Article 3 of the Convention, taking into account his allegations of overcrowding, lack of hygiene conditions and poor quality of food?
2. Has the applicant been subjected to inhuman or degrading treatment in breach of Article 3 of the Convention due to the conditions under which he was transported to and from the court hearings ?
The Government are invited to provide additional information concerning the applicant ’ s conditions of detention in Giurgiu Prison and transportation between the detention facility and the domestic courts.
