Application no. 45054/13 Gheorghe BERGHEA against Romania lodged on 10 May 2013

STATEMENT OF FACTS

The applicant, Mr Gheorghe Berghea , is a Romanian national, who was born in 1970.

The facts of the case, as submitted by the applicant, may be summarised as follows.

On 12 December 2010 t he applicant was arrested on suspicion of traffic of persons. On 16 August 2012 he was sentenced to imprisonment. Since his arrest he was detained in Aiud Prison .

The applicant states that the conditions of detention in Aiud Prison are inhuman; namely, he complains that: ( i ) in each cell in which he was detained he had less than three square metres of personal space ; (ii) the temperature in the cell in winter is too low; (iii) there are rats and parasites; (iv) the toilet fittings are defective; (v) the light in the cell is inappropriate; (vi) the prison has no designated eating area and the detainees are forced to eat in their cells, where there is no furnitur e other than the beds and (vii) the food is very bad and not adapted to his medical condition.

COMPLAINT

The applicant complained under Article 3 of the Convention about the conditions of his detention in Aiud Prison, especially with regard to overcrowding, lack of hygiene conditions and poor quality of food.

QUESTION TO THE PARTIES

Did the conditions of the applicant ’ s detention in Aiud Prison breach the requirements of Article 3 of the Convention, taking into account his allegations of overcrowding , lack of hygiene conditions and poor quality of food ?

The Government are invited to provide additional information concerning the conditions of the applicant ’ s detention in Aiud Prison.
