STATEMENT OF FACTS

The applicant, Mr András Balogh , is a Hungarian national, who was born in 1965 and is currently detained at Tiszalök Prison . He is represented before the Court by Mr D. Karsai , a lawyer practising in Budapest .

A. The circumstances of the case s

The facts of the case, as submitted by the applicant, may be summarised as follows.

Between 23 February 2006 and 26 March 2012, the applicant served his sentence at Vác , Budapest, Miskolc and Márianosztra Prisons, allegedly in overcrowded cells (1.6 to 2.1 square metres per person). (The conditions of Tiszalök Prison, where he was detained when he introduced the application, are not complained of) .

COMPLAINTS

The applicant complain s under Article s 3 and 13 of the Convention about the inhuman and degrading conditions of his detention in overcrowded cells and that he had no effective remedy in that respect.

QUESTIONS TO THE PARTIES

1. Has the applicant been subjected to inhuman or degrading treatment on account of the allegedly cramped conditions of his detention , in breach of Article 3 of the Convention?

2. Did the applicant have at his disposal an effective domestic remedy for his complaint about prison conditions under Article 3, as required by Article 13 of the Convention?
