STATEMENT OF FACTS
The applicants, Ms Kate Stojaković and Mr Nedeljko Stojakovic , are Serbian nationals, who were born in 1948 and 1967 respectively and live in Karlovac . They are represented before the Court by Mr M. Žugić , a lawyer practising in Zagreb.
The circumstances of the case
The facts of the case, as submitted by the applicants, may be summarised as follows.
The applicants ’ close relatives, Mihajlo and Davor Stojakovi ć were killed in 1991 in their house in Logori š te , allegedly by Croatian soldiers.
COMPLAINTS
The applicants complain, without invoking any provision of the Convention, that the State authorities did not comply with their obligation to identify and punish the perpetrators.
QUESTION TO THE PARTIES
Having regard to the procedural protection of the right to life, was the manner in which the criminal law mechanisms have been applied in the present cases by the domestic authorities in breach of Article 2 of the Convention?
The Government are invited to submit copies of all case files and other documents concerning the killing of the applicants ’ relatives.
