Application no. 10639/14 Bogdan Constantin MANTU against Romania lodged on 6 March 2014
STATEMENT OF FACTS
The applicant, Mr Bogdan-Constantin Mantu , is a Romanian national, who was born in 1990 and is currently detained in Vaslui Prison.
The facts of the case, as submitted by the applicant, may be summarised as follows.
Between 9 May 2012 and 1 March 2013 the applicant was detained in Ia ÅŸ i Prison. He alleges that he had to share a cell with thirty prisoners and there were not enough beds for everyone. The cell was full of bed bugs and other insects as well as rats, which kept him awake at night. There were no sanitary installations such as sink or shower. The food was ve ry low in calories and altered.
From 1 March until 26 May 2013 the applicant was detained in Rahova Prison. Here he was held in similar conditions as in Ia ÅŸ i Prison.
Since 26 May 2013 the applicant is detained in Vaslui Prison where he shares a cell with seven prisoners. The cell is provided with only six beds and for a period of three weeks the applicant had to sleep on the floor. The food is of very poor quality and is usually served after the expiry date. The applicant further alleges that he requested to be moved to a non-smoking cell but his request was rejected as there were no free places.
Finally, the applicant alleges that medical care was also of poor quality in Rahova and Vaslui Prisons. The applicant submits that in Vaslui Prison there is no prison doctor but only nurses.
COMPLAINT
The applicant complains under Article 3 of the Convention about the inhuman conditions of his detention in Ia ÅŸ i , Rahova and Vaslui Prisons. In particular, he complains of overcrowding, poor hygiene and poor quality of food and medical care. In addition, the applicant complains of being subjected to passive smoking in Vaslui Prison.
QUESTION TO THE PARTIES
Has the applicant been subjected to inhuman or degrading treatment, in breach of Article 3 of the Convention, on account of the conditions of his detention in Ia ÅŸ i , Rahova and Vaslui Prisons?
The Government are invited to submit information concerning the conditions of the applicant ’ s detention in Ia ş i , Rahova and Vaslui Prisons in particular as regards overcrowding, sanitary facilities, hygiene, the quality of food and of the medical assistance as well as concerning his exposure to passive smoking in Vaslui Prison .
