STATEMENT OF FACTS
FACTS
The applicant was born in 1981. He is represented before the Court by Ms E. Davidiyan and Ms D. Trenina , lawyers practicing in Moscow.
From 9 April 2015 on, the applicant has been staying in the transit zone of Sheremetyevo airport in allegedly substandard conditions .
COMPLAINTS
1. The applicant complains that the conditions of his stay in the transit zone of Sheremetyevo airport are in breach of Article 3 of the Convention.
2. He further complains that he is de facto deprived of his liberty in breach of Article 5 § 1 of the Convention.
QUESTIONS TO THE PARTIES
1. Has there been a violation of Article 3 of the Convention in respect of the applicant on account of the allegedly poor material conditions of his stay in the transit zone of Sheremetyevo airport?
2. Has the applicant been deprived of liberty within the meaning of Article 5 § 1 of the Convention? If so, has there been a violation of this provision (see Amuur v. France , 25 June 1996, §§ 38-54, Reports of Judgments and Decisions 1996 ‑ III)?
