Application no. 78961/11 Xhevrije HYSENAJ against Albania lodged on 15 December 2011

SUBJECT MATTER OF THE CASE

The application concerns the authorities ’ failure to inform the applicant, who is of Roma origin, of the progress of criminal proceedings against third parties who had set her home on fire, as a result of which she could not lodge a civil claim as the injured party in accordance with Article 62 of the Code of Criminal Procedure.

QUESTIONS tO THE PARTIES

1. Has the applicant exhausted all domestic effective remedies as required by Articles 35 § 1 and 13 of the Convention as regards her complaint under Article 6 § 1 of the Convention?

2. Has there been a breach of the applicant ’ s right of access to court under Articles 6 §§ 1 and 14 of the Convention on account of the authorities ’ failure to inform her of the progress of the criminal proceedings, as a result of which she has been prevented from lodging a civil claim (see Article 62 of the Code of Criminal Procedure as well as the Supreme Court ’ s unifying decision no. 284 of 15 September 2000)?
