Application no . 9114/16 Patrick ROYER against Hungary lodged on 11 February 2016

SUBJECT MATTER OF THE CASE

The application concern s the abduction of a child by one of his parents and the non-execution of the judicial decisions ordering his return.

In this application the Hungarian authorities applied Article 13 (b) of the Hague Convention and concluded to the existence of a grave risk that the child ’ s return would expose him to psychological harm and place him in an intolerable situation if returned to his father in France.

The applicant submitted his complaints relying on Article 8.

QUESTION tO THE PARTIES

Has there been a violation of the applicant ’ s right to respect for family life, contrary to Article 8 of the Convention? In particular, have the authorities observed their positive obligations under Article 8 to ensure that the applicant could properly exercise the right of access to his child?
