STATEMENT OF FACTS
The applicant, an Afghan national, arrived in Sweden in 2011. His applications for asylum, claiming that, due to an illicit sexual affair and his conversion from Islam to Christianity , he would face a real risk of being sentenced to death or subjected to torture or inhuman or degrading treatment if returned to his home count ry, were rejected by the Migration Agency and, upon appeal, by the migration courts.

The applicant complains under Articles 2 and 3 of the Convention that, if he were to be expelled to Afghanistan, he would risk being sentenced to death or subjected to torture or inhuman or degrading treatment due to an illicit sexual affair and his conve rsion from Islam to Christianity . Moreover, he complains that the Swedish authorities have failed to properly investigate his faith and the risks associated with expulsion to Afghanistan.
QUESTION
In the light of the applicant ’ s claims and the documents which have been submitted, would he face a real risk of being subjected to treatment in breach of Articles 2 or 3 of the Convention if the expulsion order were enforced?
