SUBJECT MATTER OF THE CASE

The application concerns the room confinement imposed on the applicant by his military superiors as a disciplinary measure (see TengilimoÄŸlu and Others v. Turkey , nos. 26938/08, 41039/09, 66328/09 and 66451/09, 5 June 2012).

QUESTION tO THE PARTIES

Having regard to the room confinement imposed on the applicant on 11 December 2012 as a disciplinary penalty , and to the decision of the Constitutional Court dated 12 March 2015 which found a violation without awarding any compensation , has there been a breach of Article 5 § 1 (a) of the Convention (see Tengilimoğlu and Others v. Turkey , nos. 26938/08, 41039/09, 66328/09 and 66451/09, 5 June 2012)?
