STATEMENT OF FACTS

The applicant, an Ethiopian national, arrived in Sweden in 2015. As she had previously been granted an Austrian Schengen visa on behalf of Hungary, the Migration Agency decided to transfer her to Hungary under the Dublin Regulation.

COMPLAINT

The applicant complained under Article 3 of the Convention that there is a risk for inhuman treatment if she were to be transferred to Hungary without any individual guarantees from the Hungarian authorities regarding medical attention.

QUESTION

In the light of the applicant ’ s claims and the documents which have been submitted, would she face a risk of being subjected to treatment in breach of Article 3 of the Convention if the transfer order was enforced?
