Application no. 55477/16 Yuriy Valeryevich SAYENKO against Russia lodged on 8 November 2016
SUBJECT MATTER OF THE CASE
The applicant, HIV-positive, is detained in IK-2, the Rostov Region. He complains about inadequate medical treatment, and in particular, inability to obtain antiretroviral therapy. He also argues that he does not have an effective remedy in Russia to complain about poor medical assistance in detention.
QUESTIONS tO THE PARTIES
1 . Taking into account the applicant ’ s medical history, and in particular his suffering from HIV infection and a number of concomitant illnesses, have the Government met their obligation to ensure that his health and well ‑ being are being adequately secured by, among other things, providing him with the requisite medical assistance (see McGlinchey and Others v. the United Kingdom , no. 50390/99, § 46, ECHR 2003 ‑ V), as required by Articles 2 and 3 of the Convention?
The Government are asked to provide a copy of the original and the typed versions of the applicant ’ s medical records, including the doctors ’ prescriptions and notes on their execution.
2. Does the applicant have at his disposal effective domestic remedies ‑ as required by Article 13 of the Convention – for his complaint of a lack of effective medical treatment in detention?
