STATEMENT OF FACTS
The applicants, Ms Spomenka Pergar , Mr Marijan Pergar and Mr Miroslav Pergar , are Croatian nationals born in 1966, 1961 and 1984 respectively and live in Č akovec . They are represented before the Court by Mr Z. Novaković , a lawyer practising in Zagreb.
The circumstances of the case
The facts of the case, as submitted by the applicants, may be summarised as follows.
The applicants ’ close relative, T.P., was beaten to death on 27 January 2011.
On 18 May M.M., B.H. and D.P. were indicted in the Č akovec Municipal Court for killing T.P. The proceedings are still pending.
COMPLAINT
The applicants complain under the procedural aspect of Article 2 of the Convention about the protracted response of the national authorities to the death of their close relative.
QUESTION TO THE PARTIES
Having regard to the procedural protection of the right to life (see paragraph 104 of Salman v. Turkey [GC], no. 21986/93, ECHR 2000-VII), was the response of the domestic a uthorities in breach of Article 2 of the Convention?
