Application no. 12653/15 Mihail DOGOTAR against the Republic of Moldova lodged on 28 February 2015

SUBJECT MATTER OF THE CASE

The application concerns the applicant ’ s forced hospitalisation in a psychiatric hospital for seven days after he had slapped a member of the Government in the face. The decision to hospitalise him was based on the prosecutor ’ s request to verify the applicant ’ s fitness to be a defendant in criminal proceedings. The applicant complains of a violation Article 5 § 1 of the Convention.

QUESTION tO THE PARTIES

Was the applicant deprived of his liberty in breach of Article 5 § 1 of the Convention (see David v. Moldova , no. 41578/05, 27 November 2007, and Gorobet v. Moldova , no. 30951/10, 11 October 2011)?
