SUBJECT MATTER OF THE CASE

The application concerns the lack of summoning of the applicant in the framework of civil foreclosure proceedings which ended with the auction of his holiday residence by a banking entity.

QUESTIONS tO THE PARTIES

1. Did the applicant have effective access to a court and to judicial remedies in accordance with Article 6 § 1 of the Convention having regard to the fact that the decisions rendered during the foreclosure proceedings were not personally served on him?

2. Has the applicant been deprived of his possessions in accordance with the conditions provided for by law, within the meaning of Article 1 of Protocol No. 1?
