Application no. 50153/12 Tamás KUN against Hungary lodged on 1 August 2012

SUBJECT MATTER OF THE CASE

The application concerns the allegedly excessive length of the applicant ’ s p re-trial detention lasting about 3 years and 5 months. It was ordered on 9 January 2009 on charges of multiple homicides contemplated in advance and with malicious motives and illegal possession of explosives . The court prolonged the pre-trial detention on several occasions. On 20 December 2010 it was extended until the first-instance judgment of the competent court, for fear of absconding.

On 14 June 2012 the applicant was found guilty and sentenced to life imprisonment. On 25 April 2013 the judgment was upheld on appeal.

QUESTION tO THE PARTIES

Was the length of the applicant ’ s pre-trial detention in breach of the “reasonable time” requirement of Article 5 § 3 of the Convention?
