SUBJECT MATTER OF the CASE
The applications concern the local elections in Kyiv. The applicants are internally displaced persons (IDPs) who used to be residents respectively in the city of Donetsk (28658/16) and in the Crimea (24919/16). They moved to Kyiv between six to eighteen months prior to the local elections held in October-November 2015. They were denied possibility to vote even though under the Local Elections Act all residents of the given constituency were entitled to vote in the respective local elections. The applicants challenged the refusals to participate in those elections both before the election commissions and the courts, but to no avail.
They refer to Article 1 of Protocol 12 claiming that they were discriminated because they were officially registered as residents of the territories outside the Government control and their factual continuous residence as IDPs in Kyiv was disregarded.
QUESTION
Did the applicants suffer discrimination in the enjoyment of their rights guaranteed by the domestic law on local elections, contrary to Article 1 of Protocol No. 12 to the Convention?
