SUBJECT MATTER OF THE CASE
The applicant is a Turkish national who was born in 1974 and lives in Bing ö l . He was the head of the Bing ö l branch of the DTP (Party for a Democratic Society) at the time of the events giving rise to the present application. The application concerns the conviction of the applicant for membership of the PKK, an illegal armed organisation , under Articles 220 § 6 and 314 of the Criminal Code and for disseminating propaganda in favour of the PKK under section 7 § 2 of the Prevention of Terrorism Act on account of his participation in a demonstration and making a speech during that demonstration. The applicant relies on Articles 6, 9, 10, 11 and 14 of the Convention.
QUESTION tO THE PARTIES
Has there been a violation of the applicant ’ s right to freedom of expression, contrary to Article 10 of the Convention, or his right to freedom of assembly, contrary to Article 11 of the Convention, on account of his convictions under Articles 220 § 6 and 314 of the Criminal Code and section 7 § 2 of the Prevention of Terrorism Act?
