SUBJECT MATTER OF THE CASE

The application concerns the use of force by the police in order to disperse a peaceful demonstration which took place without prior authorisation.

QUESTIONS tO THE PARTIES

1. Has there been a violation of the applicant ’ s right to freedom of peaceful assembly, contrary to Article 11 of the Convention (see, by way of comparison, Kudrevicius and O thers v. Lithuania , [GC] 15 October 2015, application no. 37553/05)?

2. In particular, were the measures taken by the police – and endorsed by the Audiencia Provincial of Valladolid – necessary in terms of Article 11 § 2?
