Application no. 74514/11 Valerii ȘIȘANOV against the Republic of Moldova lodged on 14 November 2011

SUBJECT MATTER OF THE CASE

The application concerns the applicant ’ s detention in allegedly inhuman conditions in prison no. 13 (notably severe overcrowding and lack of basic facilities), as well as his frequent transfers from one prison to another, which causes him unnecessary suffering in view of the fact that he has a disability (one leg missing).

The applicant complains under Article 3 of the Convention about being held in inhuman condition of detention and under Article 13 about the absence of an effective remedy in respect of his complaint under Article 3.

QUESTIONS tO THE PARTIES

1. Has there been a violation of Article 3 of the Convention, notably because of the conditions of the applicant ’ s detention and his frequent transfers from one prison to another, considering his disability (see Shishanov v. Moldova , no. 11353/06, §§ 101 and 123-139, 15 September 2015)?

2. Has there been a violation of Article 13 of the Convention taken in conjunction with Article 3 (see Okolisan v. the Republic of Moldova , no. 33200/11 , § 41, 29 March 2016 )?
