Application no. 72114/13 Ágnes Tünde CZEBE and others against Hungary lodged on 12 November 2013

SUBJECT MATTER OF THE CASE

The application concerns the fairness of the Kúria ’ s procedure in a case brought by the applicants in July 2007 against the Tax Authority and the Pest County Municipality concerning outstanding bonus payments. They complain under Article 6 § 1 that the Kúria adjudicated an interim question of their case on 20 February 2013 (service: 15 May 2013) without ever notifying or involving their lawyer, as a result of which they could not make representations, have access to the case documents or react to events of the procedure in any manner. The final decision closing the case was given by the Kúria on 30 January 2015.

QUESTIONS tO THE PARTIES:

1. Did the applicants have a fair hearing in the determination of their civil rights and obligations, in accordance with Article 6 § 1 of the Convention? In particular, was the principle of equality of arms respected in the Kúria ’ s procedure leading to the interim judgment?

2. Was the length of the proceedings in the present case in breach of the “reasonable time” requirement of Article 6 § 1 of the Convention?

3. Did the applicants have at their disposal an effective national remedy to accelerate the proceedings as required by Article 13 of the Convention?
