Application no. 39448/14 Zoltán Tamás KISS against Hungary lodged on 20 May 2014

SUBJECT MATTER OF THE CASE

The application concerns criminal proceedings conducted against the applicant on charges of misappropriation of public funds. While the applicant was detained on remand, on 21 March 2012 a senior judge of the court trying the applicant issued a press release in which some of the conducts reproached to the applicant were presented as proven facts linked to his person. At this point in time, no first-instance judgment had yet been given in the case. The applicant ’ s civil action based on the insinuation contained in the press release was to no avail. The applicant complains that this state of affairs amounted to a breach of the presumption of innocence protected by Article 6 § 2 of the Convention.
