Application no. 25294/15 Endréné KOVÁCS against Hungary lodged on 13 March 2013

SUBJECT MATTER OF THE CASE

The application concerns the applicant ’ s disability benefit whose monthly amount was reduced (on 11 October 2012, in application of the new relevant legislation in force as of 1 January 2012) to 55,800 Hungarian forints (HUF) (180 euros (EUR)) from its previous amount of HUF 165,000 (EUR 530), a decrease of some 67%.

She relied on Article 1 of Protocol No. 1 and Articles 6, 8, 13 and 14 of the Convention.

QUESTION tO THE PARTIES

Did the reduction of her disability benefit impose an excessive individual burden on the applicant, in breach of Article 1 of Protocol No. 1 (see Lengyel v. Hungary , no. 8271/15 , 18 July 2017)?
