SUBJECT MATTER OF THE CASE
The applicant is a Turkish national who was born in 1980 and lives abroad. At the time of the events giving rise to the application, he was the owner and the editor-in-chief of a periodical entitled “ Özgür Halk ” ( Free People). The application concerns the criminal proceedings brought against the applicant for disseminating propaganda in favour of an illegal organisation under section 7 § 2 of the Prevention of Terrorism Act (Law no. 3713), on account of the content of certain articles published in the issue of 15 March 2004 (issue no. 148) of the periodical. The copies of issue no. 148 periodical were confiscated and, the applicant was convicted several times in the same set of proceedings. All first-instance judgments convicting the applicant were quashed by the Court of Cassation. On 30 October 2012 the first-instance court decided to discontinue the proceedings because the prosecution became time-barred.
