SUBJECT MATTER OF the CASE

The case concerns the applicant ’ s inability to observe Muslim faith by performing worship in detention at the time prescribed by his religion, his disciplinary sanction for praying at night, and the existence of an effective domestic remedy in that respect.

QUESTIONS

1. Has there been a violation of the applicant ’ s freedom of religion set forth in Article 9 of the Convention on account of his inability to commit worship at the time prescribed by his religion, in particular, in view of his disciplinary sanction for praying at night?

2. Did the applicant have at his disposal an effective domestic remedy as required by Article 13 of the Convection to complain about his inability to commit worship at the time prescribed by his religion?
