THIRD SECTION
Application no. 13439/14 FOND SODEYSTVIYA ZASHCHITE ZDOROVYA I SOTSIALNOY SPRAVEDLIVOSTI IMENI A. RYLKOVA against Russia lodged on 6 February 2014
SUBJECT MATTER OF THE CASE
The application concerns the revocation of the domain name of an activist website (rylkov-fond.ru) which promoted the treatment of opioid addiction with banned substances – methadone and buprenorphine. The applicant, a non-governmental organisation, complains under Article 10 of the Convention (freedom of expression) that the revocation was unlawful, pursued no legitimate aim, and was not necessary in a democratic society.
QUESTIONS tO THE PARTIES
1. Has there been an interference with the applicant ’ s freedom of expression, in particular its right to impart information and ideas, within the meaning of Article 10 § 1 of the Convention?
2. Did the applicant ’ s website remain accessible to the public after the revocation of its domain name (e.g. by the IP address or another domain name)? If yes, did the revocation of the domain name amount to a “significant disadvantage” within the meaning of Article 35 § 3 (b)?
3. Was the alleged interference prescribed by law and necessary in terms of Article 10 § 2?
